Purchasing from Beneath the Badger Tree

 

When you make a purchase you agree to these Terms and Conditions and the use of your personal information as laid on in the Privacy Information.

 

You must be over 18 years old to make a purchase.

 

You must provide an accurate name, billing address, postal address if different from billing address, and email address when you make a purchase. You must not use anybody else's personal information unless you have permission to do so.

 

Products are described as accurately as possible, but if you aren't happy with your purchase you can return it for a full refund as outlined in the Refund and Cancellation Policy.

 

I reserve the right to decline or cancel an order.

Site Registration and Use

 

When you create a member account you will need to create a username which may be publicly visible. You may also choose to submit other information that may be publicly visible, such as a profile picture and 'About' information. You may share comments and forum posts that may be publicly visible and shareable. By submitting this information you agree to it being shared with other site members and publicly on the internet, in accordance with my Privacy Policy.

 

Please keep your login details confidential. If you feel that your login details may be being used by somebody else please get in touch as soon as possible.

 

You can edit your profile information, join or leave the community and change your notification settings in your Profile page. If you no longer wish to have site membership please contact me at jane@beneaththebadgertree.com or via the Contact Page and I shall delete your account within seven working days.

 

You can edit or delete your own comments. These can be easily accessed from your Profile page.

 

You must not use anybody else's personal information to create an account without their permission.

 

You must not share anybody else's personal information in posts or comments without their permission.

 

You must not create a member account if you are under the age of 16.

 

I reserve the right to delete remove your site membership if I feel you are in breach of these Website Terms of Use or the Website Code of Conduct.

Care and Safety

Care and Safety

The products I make are not toys, and are not intended for use by children under 14 years of age. Please keep out of reach of small children to prevent the risk of choking on small parts.

 

You may not receive the actual item photographed. Each one is individually hand sculpted, no moulds are used to create these little fellas, so they may vary slightly in character. Some will be cheeky, some shy, some downright mischievous, however each will certainly be of the same style and colours.

 

Every little creature I make takes a small piece of me with them, so when they come to you they will bring a lot of love, but also maybe a few tiny cracks, flaws and imperfections. I hope that you will be able to love them despite this.

 

The products I make are delicate due to the intricate nature of the designs. Please handle with care while wearing, using and storing. Please refer to your product's Care and Safety card.

 

The products I make are not intended for use with food, apart from the cake toppers which must be used with the food grade acetate sheet if one is provided.

 

Delivery
 

Delivery

Items will be dispatched within 5 - 7 working days days of order.

 

Unfortunately I cannot be responsible for any delays during delivery, especially in busy periods.

 

Until your order is considered lost in the post I cannot offer a replacement or a refund, however, if an item arrives too late to be used as intended you have the right to return it, as detailed below.*

The highest delivery rate will apply for mixed orders under £75.

Parcels may require a signature upon delivery.

 

1st Class items which do not arrive within 11 working days of dispatch will be replaced or fully refunded.

2nd Class items which do not arrive within 13 working days of dispatch will be replaced or fully refunded.

 

Special Delivery items which do not arrive within 6 working days of dispatch will be replaced or fully refunded.

 

International Orders

 

If you'd like to make a purchase from outside the UK please drop me a message through the 'Request Custom Order' button in my Etsy shop stating which item(s) and gift box option(s) you'd and I shall set up a private listing for you to purchase.

Items will be sent using International Tracked and Signed delivery. There will be an additional delivery charge of £17.

​

Please check import restrictions before ordering.

​

Buyers are responsible for any additional customs, import and sales taxes that may apply.

​

Etsy listings not purchased within 2 weeks will cancelled and relisted.

​

Orders to Europe should arrive within 1 week of dispatch. European orders are considered lost in the post 25 working days after dispatch, so items not arriving within this time will be replaced or fully refunded.

 

Orders to anywhere else in the world should arrive within 1-2 weeks of dispatch. International orders beyond Europe are considered lost in the post if they do not arrive within 32 working days of dispatch, so items not arriving within this time will be replaced or fully refunded.

 

Refund  and Cancellation Policy

Refunds and Cancellations

I am under a legal duty to supply goods that conform with the contract of sale.

 

If you aren't satisfied with your product or change your mind I will happily exchange an item or fully refund it, including the outgoing delivery costs, if it is returned to me (in its gift box, complete with the gift card if one was included) in an unused and resalable condition.

 

I may make a reduction from the reimbursement for loss of value of any item if it has been used other than to inspect it.

 

Please contact me within 14 calendar days of receipt to let me know that you intend to cancel the contract of sale. A cancellation form can be found here should you wish to use it, but an email or letter is also fine. If I do not hear from you within 14 days I will assume you are happy with your purchase.

 

The item must be returned within 14 days of cancellation.

 

Return postage costs are the responsibility of the buyer.

 

INTERNATIONAL RETURNS must be clearly marked as a 'Returned Goods' on the customs label or front of the packaging, otherwise customs and import taxes and handling fees may be deducted from the amount refunded.

 

Refunds and exchanges will be processed once I receive the returned item.

 

Please obtain proof of postage when you return an item as I cannot be responsible for items lost or damaged in the post when they are being returned.

 

Colour matched and custom orders are returnable only at my discretion. I shall send photographs before delivery to ensure that you are happy with your order. Any problems should be cleared up at this point. However, do please contact me immediately if you are not happy with your order once it arrives and I shall see what I can do to rectify things.

 

Items that reach you damaged, or develop a fault within 6 months, will be repaired, exchanged or, if you choose, fully refunded (including all postage costs). Please contact me within 2 days of you receiving the item or of the fault arising, preferably with a picture of the item and packaging to show the damage, and return the item and packaging within 7 days.

 

Refunds, repairs and exchanges will be processed upon me receiving the returned item for inspection.

 

I shall refund your return postage costs for damaged items (up to the amount stated for delivery on the item description). Please retain proof of postage.

 

If an item develops a fault within 12 months that is not due to normal wear and tear, misuse or accidental damage, I will be happy to repair the item, where possible, if it is returned to me. The buyer is responsible for postage costs.
